Homa Bay County officials charged in Ksh.348M Assembly office block corruption case

Six former Homa Bay County officials and a private company have been charged by the Office of the Director of Public Prosecutions over the alleged embezzlement of Ksh.348 million meant for the construction of the Homa Bay County Assembly office block. Those charged include: • Odhiambo Daniel Kaudo, former Clerk of the County Assembly • Patrick Tonui, former senior superintendent quantity surveyor, State Department for Public Works • Faith Adhiambo Apuko, former Clerk of the County Assembly • Roseline Anyango Odhiambo, former CEC for Lands and Housing • James Mumali Oyukah, Public Health Officer • Mary Pauline Oduor, Principal Nurse • Hartland Enterprises Limited The accused face a range of offences, including abuse of office, willful failure to comply with public finance laws, conflict of interest, and unlawful acquisition of public property. Prosecutors allege that in February 2022, Kaudo improperly awarded Hartland Enterprises a Ksh.348 million tender that had not undergone competitive bidding. Apuko is accused of facilitating irregular payments, while Roseline Odhiambo allegedly authorized construction without a valid allotment letter. Kaudo and Apuko also face additional charges for approving payments without mandatory documentation, including a valid performance guarantee. Oyukah and Oduor — who are spouses — were charged with conflict of interest for allegedly benefiting from the tender through a company they direct. Together with Hartland Enterprises, they are also accused of unlawfully acquiring Ksh.66,714,925 between September 2021 and April 2023 for work that prosecutors say was never done. All accused persons pleaded not guilty before Kisii Chief Magistrate Mildred Obura. Prosecutors Solomon Njeru and Victorine Kitoto requested stringent bond terms, citing the gravity of the charges. The court granted Ksh.30 million bond with one surety for Kaudo, Apuko, Tonui, Oyukah, Roseline Odhiambo, and Hartland Enterprises The court also set a Ksh.5 million bond with two sureties for Mary Oduor. The case is scheduled for mention on February 2, 2026.
